I sublet commercial premises in a block of flats from the housing community. Until now, I have been disposing of waste in shared bins (where other residents do). Do I need to submit a separate declaration? And what about the bins?

The obligation to submit a declaration applies to the owner of the property within the meaning of the Act on maintaining cleanliness and order in the municipality, i.e. in this case, the management board of the housing community. The formal and legal representative of the housing community is the management board of the community, which submits the declaration on behalf of all residents and tenants.

Why should I enter all this complicated data into the declaration when the authorities already have it in their databases? The property tax department has the plot numbers and the floor areas of flats and houses. The population register has my PESEL number. Why should I do the work of civil servants?

Submitting a declaration is a statutory obligation of all owners of properties where municipal waste is generated, and the data specified in the declaration to be completed is necessary for purposes related to the identification of the property and its owner, as well as for the settlement of the fee.

Waste disposal fees for properties inhabited by residents.

If waste is collected and picked up selectively, the municipal waste management fee for properties where residents live is set at:
a) PLN 0.88 per month for each 1 m2 of residential space not exceeding 110 m2,
b) PLN 0.10 per month for each 1 m2 of residential space exceeding 110 m2.

2. If the property owner fails to comply with the obligation to collect waste selectively, an increased municipal waste management fee shall be set at:
a) PLN 1.76 per month for each 1 m2 of residential space not exceeding 110 m2,
b) PLN 0.20 per month for each 1 m2 of residential space exceeding 110 m2.

Yes. You will receive notifications about upcoming payments on your phone. If you wish, you can conveniently enable or disable them. Simply press More in the bottom menu, then Notifications.

Why, apart from obvious personal details such as date of birth, PESEL or NIP, place of residence, do you have to provide the date from which you have been living in a given property, its Land and Mortgage Register number, plot number and cadastral district? After all, this is not necessary for rubbish collection!

This information is necessary to identify the owner of the property where municipal waste is generated and to determine which municipality/sector the property belongs to.
The date is provided in order to determine when the obligation to pay the waste collection fee and to provide the property with waste containers arises.

Let us assume that, according to my declaration, I sort waste, but I will be throwing away unsorted waste. How can anyone tell that I am not actually sorting waste?

The controlling entity is the company responsible for municipal waste collection in a given sector. Waste containers located at waste collection points (or waste shelters) will be subject to inspection. If waste segregation is found to be lacking, the property owner will be asked to segregate the waste (they will receive a so-called “red card”). If the owner continues to act in breach of the declaration, a decision will be issued changing the fee rate.

Can I simply enter GPS data in the declaration instead of the plot number and other data from the land registry? After all, this is the most accurate location.

GPS data does not constitute sufficient grounds for determining the owner of a property under current legislation. Furthermore, it is not just a matter of location, but of determining the legal status of the property and its owner.

Why, despite the assumption that I sort waste into five categories (the municipality and the waste management company will incur lower management costs as a result), can I not pay less than before?

Strict regulations are raising waste management and environmental protection requirements in Poland year after year. In order to meet these requirements, further investments, reorganisations, expansion of the waste collection system, etc. are necessary. These activities generate additional costs, which translate into fees for residents. Selective waste collection is more expensive, if only because several transport vehicles are needed to collect the same amount of waste. These costs are partially offset by the income from the sale of these raw materials for recycling.

Should I also include the garage space in a detached house in the area for which I will pay for waste collection? What about garages/garage halls under blocks of flats?

The fee should be calculated based on the living space of the premises, whereas a garage is not considered living space.

What are the consequences of failing to submit a declaration on time or failing to submit it at all?

In the event of failure to submit a declaration on the amount of municipal waste management fee or justified doubts as to the data contained in the declaration, a decision will be issued specifying the amount of the municipal waste management fee, taking into account reasonable estimates, including the average amount of municipal waste generated on properties of a similar nature.

I am not going to fill in the declaration. Personal data protection applies. The most important thing is that I declare that I will sort waste. Besides, the Municipal Services Department has no right to collect such data from anyone! In my opinion, it is not authorised to do so, because only the Tax Office can collect such data!

Completing and submitting the declaration is a statutory obligation of every property owner, and the data contained therein will be protected in accordance with applicable regulations. By decision of the Gdańsk City Council, declarations should be submitted to the Department of Municipal Services.

I am not going to pay anyone for anything. I will take the rubbish to the waste disposal plant in Szadółki myself.

According to the law, if a person resides in a property, they are obliged to submit a declaration and pay a waste collection fee. At the same time, they cannot deliver waste to the waste collection facility on their own, because according to the regulations, the facility cannot collect household waste from individuals.

Polish law prohibits charging fees if you submit a notification that you will be temporarily absent from the premises (e.g. due to travelling abroad). What should you do in such a situation?

In the case of properties inhabited by residents, the obligation to pay municipal waste management fees arises for each month in which a resident lives on the property. In the event of temporary absence or re-occupation, new declarations must be submitted each time.
